Introduction
These terms and conditions (“Agreement”) govern the sale of car audio products (“Products”) by ASL Car Audio Sdn. Bhd. (“Seller”) to the purchaser (“Buyer”). By placing an order for Products, Buyer agrees to be bound by this Agreement.
Orders
Buyer may place an order for Products by contacting Seller via email or through the Seller’s website. All orders are subject to acceptance by Seller. All orders will be subjected to acceptance once the Seller’s authorized dealer accepted the order.
Payment
Buyer agrees to pay the full purchase price for Products at the time of order. Payment can be made by credit card, Billplz, or bank transfer. Seller reserves the right to cancel any order if payment is not received within a reasonable time.
Shipping
Seller will ship Products to Buyer’s designated shipping address. Shipping costs are the responsibility of Buyer and will be added to the purchase price. Seller will use reasonable efforts to ship Products within a reasonable time after payment is received. Seller is not responsible for any delays or damages caused by the shipping carrier.
Buyer can decide to either collect the product(s) from one of our authorized dealers or receive product(s) shipped directly from Seller. The shipping cost will be waived if it’s collected from our authorized dealer. If Buyer wants to receive product(s) shipped from Seller, Seller will then ship Products to Buyer’s designated shipping address. Shipping costs are the responsibility of Buyer and will be added to the purchase price. Seller will use reasonable efforts to ship Products within a reasonable time after payment is received. Seller is not responsible for any delays or damages caused by the shipping carrier.
Returns and Refunds
Buyer may return Products within 14 days of receipt for a refund, provided that the Products are in their original condition and packaging. Buyer is responsible for return shipping costs. Refunds will be issued within a reasonable time after receipt of returned Products. Seller reserves the right to refuse returns or refunds for Products that have been damaged or altered in any way.
Warranty
Seller warrants that Products will be free from defects in materials and workmanship for a period of one year from the date of purchase. If Products are found to be defective within this period, Seller will, at its option, repair or replace the Products. This warranty does not cover damage caused by misuse, abuse, or improper installation.
Limitation of Liability
Seller’s liability for any claims related to Products is limited to the purchase price paid by Buyer for the Products. In no event shall Seller be liable for any incidental, consequential, or punitive damages arising from the use or inability to use the Products.
Indemnification
Buyer agrees to indemnify, defend, and hold harmless Seller, its officers, directors, employees, agents, and affiliates from any claims, damages, or expenses arising from Buyer’s use of Products.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Malaysia, without giving effect to any choice or conflict of law provision or rule. Any legal action arising from or relating to this Agreement shall be brought in the courts of Selangor.
Entire Agreement
This Agreement constitutes the entire agreement between Buyer and Seller with respect to the sale of Products and supersedes all prior or contemporaneous communications and proposals, whether oral or written. No modification or amendment of this Agreement shall be binding unless in writing and signed by both parties.
Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of this Agreement.
By placing an order for Products, Buyer acknowledges that he or she has read and understood this Agreement and agrees to be bound by its terms and conditions.
